Welcome to The Marmalade Club (Pty) Ltd Privacy Policy (“Policy”). This Policy applies to all users of our website, related mobi-sites, and software applications collectively referred to as our “website”, which are used to access and purchase our products and services.
The Marmalade Club respects your privacy and is committed to protecting your personal data. This Policy will inform you as to how we look after your personal data when you visit our website (regardless of where you visit it from) and tell you about your privacy rights and how the law protects you. “Applicable Laws” means local, foreign, and international laws, regulations, treaties, and codes, for example, the Electronic Communications and Transactions Act 25 of 2002 and the Consumer Protection Act 68 of 2008.

The Marmalade Club takes your privacy and the protection of your personal information very seriously, and we will only use your personal information in accordance with this Policy and applicable data protection legislation. We have implemented reasonable technical and operational measures to keep your personal information secure. We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed.

The information which we may collect about you
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:
Identity Data includes first name, maiden name, last name, username or similar identifier, title, date of birth, and gender.
Contact Data includes billing address, delivery/shipping address, email address, telephone numbers, and emergency contact telephone numbers.
Financial Data includes bank account and payment card details.
Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.

You warrant that the information you have provided is accurate, current, true and correct and that it does not impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or anything.
We also collect, use, and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data, but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Policy.
We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses.
If you fail to provide personal data
Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.

Marketing
We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising. We have established a preference centre where you can view and make certain decisions about your personal data use. This can be found under My Account.
We want to personalise your experience with The Marmalade Club so that you get the most relevant information about our products and services, at the right time. The most effective way of doing this is for The Marmalade Club to create a profile of you for marketing purposes, so that we can only recommend you the products we think you are going to like.
We will build your profile based on information you give us and we may supplement this information with marketing insight from third party companies and information in the public domain. We also use services such as Facebook’s Custom Audience and Google’s Customer Match.
You don’t have to give The Marmalade Club any of the following information, but without it we cannot tailor our marketing to suit you and we may not be able to fulfil your order if you buy online.
The Marmalade Club will remember your name, age, address, contact number and e-mail address. To make sure The Marmalade Club only sends you the things you’ll love, our emails will collect information like whether you’ve opened or clicked the email, your device type and general area in which you open it.
The Marmalade Club may analyse how you use our website by recording your mouse clicks, mouse movements, page scrolling and any text keyed into website forms (not including bank details or any sensitive personal data). The Marmalade Club uses this information to improve our website usability and may use your activity on our website to personalise marketing to you when you visit other websites.
The Marmalade Club will remember your purchase history so we can make sure you’re the first to find out about products people like you are buying, and products that will complement the ones you have already bought from us.
If you don’t complete your purchase, The Marmalade Club will keep track of what you put in your shopping bag for when you return to our website, and may remind you of what is in your shopping bag via email or banners on other websites.
The Marmalade Club may use the information you have publicly shared on social media to make sure you only get product recommendations from us that are suited to you. If you give us information about your friends (which you should only do with their permission), The Marmalade Club may recommend suitable products to them.
If you submit user generated content through our social media channels, we may use your username or email address to communicate with you, in addition to using your photo. The use of your photo would include, but not be limited to, The Marmalade Club's social media channels and website. We may also use your IP address and geolocation to filter content by region, country or other local area. Such data is only used with your consent.
You can unsubscribe from The Marmalade Club’s marketing communications at any time by clicking on the link found at the bottom of every marketing email, by updating your account preferences on our website, or by emailing customerservice@themarmaladeclub.co.za. Please note that it may take up to 7 days for any changes to take effect.
Promotional offers from us
We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (this is “marketing”).
You will receive marketing communications from us if you have requested information from us or purchased goods or services from us and, in each case, you have not opted out of receiving that marketing. You will also receive marketing communications from us if you have provided us with your details when you entered a competition or registered for a promotion and gave us your consent as part of that process.

To improve your experience when shopping on the website we use cookies. A cookie is a piece of information our website will place on your computer’s hard drive that can track your movements while you are on the website. It will also recognize you when you visit our website again.
Cookies are stored for us to continually improve our website and provide a better online shopping experience for you. The data that we collect from you may be transferred to, and stored at, a destination outside of the Republic of South Africa (RSA). It may also be processed by staff operating outside of the RSA who work for us or for one of our third-party suppliers. Such staff may be engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. Whenever we transfer your personal data out of the RSA, we shall ensure that any such transfer is lawful and that a similar degree of protection is afforded to it in accordance with POPIA.

Retention of your information

By accessing and using the website, you consent to us retaining records of your Personal Information for no longer than may be necessary to achieve the purpose for which the information was initially collected or subsequently processed.
Access to, correction and deletion of your personal information
You may request details of personal information which we hold about you under the Promotion of Access to Information Act 2 of 2000 (“PAIA”). Fees to obtain a copy or a description of personal information held about you are prescribed in terms of PAIA. Confirmation of whether or not we hold personal information about you may be requested free of charge. You may request the correction of personal information The Marmalade Club holds about you. Please ensure that the information we hold about you is complete, accurate and up to date. If you fail to keep your information updated, or if your information is incorrect, The Marmalade Club may limit the products and services offered to you or elect not to open your account.
You have a right in certain circumstances to request the destruction or deletion of and, where applicable, to obtain restrictions on the processing of personal information held about you. If you wish to exercise this right, please contact us using the contact details set out above.

We try to respond to all legitimate requests within one month. Occasionally, it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
What do credit bureaux and fraud prevention agencies do with my information?
We may share your personal data (provided to use as set out in this Policy) with credit bureaux and fraud prevention agencies.
You have a legal right to obtain details of those credit bureaux and fraud prevention agencies from whom we obtain and to whom we pass information about you. You also have a right to further details explaining how the information held by fraud prevention agencies may be used

Glossary
For purposes of this Policy:

"Client" or “you” means any prospective, new or existing client of The Marmalade Club.
“Comply with a legal or regulatory obligation” means processing your personal data where it is necessary for compliance with a legal or regulatory obligation that we are subject to.
“Consent” means you have explicitly given us permission to process your personal data. In such circumstances we will have asked you a specific question and you will have entered information or ticked a tick-box to indicate your consent.
“Legitimate Interest” means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests.
